In the Pursuit of Social Justice: Assessing the Debates Regarding the Uniform Civil Code in India

Social justice is a concept that aims to address and rectify structural inequalities and systemic injustices and seeks to promote fairness, equality, and equitable treatment for all individuals and groups in society. In the Preamble of the Constitution, it has been listed as one of the most significant objectives of the Indian State. Such a legal instrumentalist approach, however, has both structural and practical constraints. Firstly, in a heterogeneous, unequal society like India, it is extremely difficult for the democratic State to cater to the concerns of all communities simultaneously.
